Google Loses Groovle Case
Any name that starts with a G, has two OOs and ends in le is potentially owned by Google. The recent court battle, which Google lost, indicates the same. Google filed a complaint against Groovle that they have a business similar to Google. But, the mediators at the National Arbitration Forum disagreed. The Canadian website called Groovle.com has won the case.
Google said in its complaint that the domain name was too similar to its own, but the judges appointed by the National Arbitration Forum rejected the complaint. It is the National Arbitration Forum which provides arbitration and mediation services to businesses. The agency is approved by the ICANN to sort out domain name disputes.
The irony is that Groovle uses Google search to show results and generate revenue from the ads displayed in the search results. Google also indexes content created by others and generate revenue by displaying ads. Google has been fighting lawsuits over copyright infringements by media houses and authors every now and then for indexing their copyrighter content.
But, in this case, what issues did Google have? The name Groovle which 'sounds' like Google or the business model? I guess both.
The NAF judges also rejected Google's concern that Groovle was registered in a bad faith and had no "legitimate" interest in the domain name. A similar case was filed by Google against Froogles.com. But the court dismissed Google's complaint.
Google should listen to Shakespeare who said, "What's in a name?" Look at Microsoft, they have been trying to get things fixed by changing name of their search engine every year. Microsoft should try something called Doodle. It may eventually work!
